Brad Simpson and James Vallee Cotter have a 25-year friendship and a documented history of deceptive business practices, primarily centered around a legal dispute with the real estate company Cotter & Sons.
The Secret Cleaning Company and Conflict of Interest From 2002 to 2012, Brad Simpson worked as a property manager for Cotter & Sons, a company owned by James Val Cotter’s father, James F. Cotter. In 2009, Brad and James Val Cotter secretly formed their own cleaning company called Premier Facility Solutions. In a clear conflict of interest, Brad then hired his own company to handle the cleaning contracts for Cotter & Sons, charging an “above market rate” so he could personally profit from his employer’s expenses.
The Sale and “Skullduggery” When James F. Cotter discovered Brad’s ownership of the cleaning company, he ordered Brad to dissolve it and find someone else to do the job. Instead, Brad and James Val Cotter negotiated a deal to sell Premier Facility Solutions’ assets to another janitorial company called BJ Corp for $100,000. However, Premier’s only actual assets were the inflated cleaning contracts with Cotter & Sons. At the same time, Brad and James Val Cotter—both claiming to be vice presidents—created new janitorial contracts on behalf of Cotter & Sons with BJ Corp, even though they lacked the actual authority to make or sign such agreements.
The Resulting Lawsuits These deceptive maneuvers led to a complex web of litigation:
  • BJ Corp Lawsuit (2012): When Cotter & Sons refused to pay for the cleaning services at 10 of their office buildings, BJ Corp sued them. BJ Corp also sued Brad and James Val Cotter for fraud after learning the two men did not actually have the authority to execute the contracts.
  • Cotter & Sons Lawsuit (2013): Cotter & Sons turned around and sued Brad Simpson for commercial bribery and breach of fiduciary duty, arguing that Brad should be responsible for the damages BJ Corp was seeking.
The case went to trial in 2015, where a judge ruled that Cotter & Sons had to pay BJ Corp over $930,000 in damages, interest, and legal fees, but BJ Corp could not collect any money directly from Brad or James Val Cotter. The case was appealed to the Texas Supreme Court and was eventually resolved with a confidential settlement in 2018.
This history of illicit collaboration has continued into the present investigation regarding the murder of Suzanne Simpson. Following Suzanne’s disappearance, Brad Simpson enlisted James Val Cotter to hide an illegal, fully automatic AK-47 inside a wall cavity behind a mounted TV in Cotter’s bedroom.
